Ms. Srishti Singhania specializes in international commercial arbitration and mediation, intellectual property rights, corporate and commercial laws, and estate and succession planning. Prior to joining the Firm, she worked at the Mumbai office of Cyril Amarchand Mangaldas. Her previous work experience includes: advising and assisting in a high-stake international commercial arbitration where the infringing party had copied the Client’s derivative product; working on mergers and acquisitions in the field of renewable energy; and advising and assisting high net worth individuals on matters relating to succession and estate planning.
At the Firm, she has been assisting and advising clients in protecting and registering their intellectual property rights, especially trademarks, industrial design and copyright. She has assisted them from conducting thorough public search to registering their trademarks to filing oppositions against deceptively similar marks. She also assists clients in drafting and sending cease and desist notices to the infringing party, and represents clients in trademark and copyright infringement suits. Clients have appreciated her for having an eye for detail, doing through legal research and analysis and coming up with a practical legal solution.
With respect to the commercial and corporate practice, she regularly assists clients in drafting and reviewing their commercial and real estate contracts, and employment agreements, such as car leasing facility agreement, leave and license agreements from commercial premises etc. She aims at mitigating the client’s business risk by incorporating protective clauses in commercial contracts. She also provides company secretariat support to clients – ensuring that they comply with the annual company compliances in a timely manner. She has also assisted foreign companies in establishing their Information Techonology (IT)/Information Technology Enabled-Services (ITES) units in Mumbai and Navi Mumbai, and procuring the requisite registrations.
Being a trained mediator, she strongly believes in getting the litigating parties together so that they can come up with a win-win solution. She has also advised and represented clients in international and domestic commercial arbitrations arising out of breach of construction and consultancy contracts. Presently, she is assisting in an arbitration against the National Highways Authority of India where the toll charged imposed upon the client is being disputed. She also represents clients in various commercial disputes before the Bombay High Court, Bombay City Civil Court, and National Company Law Tribunal Mumbai. In order to encourgae alternative dispute resolution in India, she also encourages law students to specialise in this field by assessing them at various moot mediation and arbitration competitions organised by reputated law schools of India.
In order to ensure that her clients are up-to-date with the latest legal developments, she regularly contributes articles to reputed publications such as Construction Times, BW Legal World, Infrastructure Today, Asian Institute of Alternative Dispute Resolution Newsletter, the Financial Express. She has also conducted knowledge-sharing sessions for the clients of the Firm on succession planning and cyber security.
Apart from being a lawyer, she also assists the Firm in mentoring and training the legal interns. She also contributes to the business development, and learning and development initiatives at the Firm. She is appreciated for her sincerity and commitment to perfection. On the personal front, she is an active member of Bharat Soka Gakkai, an organisation engaged in peace, culture and education activities based on the humanistic philosophy of Nichiren Buddhism, and committed to contibuting to world peace.
